Terms of Service

1. Acceptance of Terms

By accessing and using the Epic Outdoor website and services (collectively, the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.

Epic Outdoor LLC ("Epic Outdoor," "we," "us," or "our") operates the epicoutdoor.win website and related services. These Terms of Service ("Terms") govern your access to and use of our Service.

2. Description of Service

Epic Outdoor is an affiliate marketing platform that connects users with outdoor retail partners. When you make purchases through our affiliate links, you may earn cashback rewards and sweepstakes entries. We act as an intermediary between you and our retail partners; we do not sell products directly.

Our Service includes:

  • Curated links to outdoor retail partners
  • Cashback reward tracking and disbursement
  • Sweepstakes entry management and drawings
  • Content including gear reviews, buying guides, and trail guides

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.

4. Cashback Rewards

Cashback rewards are earned when you make qualifying purchases through our affiliate links. The cashback rate varies by retailer and is displayed on each retailer's page. Cashback is subject to the following conditions:

  • Cashback is calculated based on the commission we receive from the retailer, which may differ from the advertised rate in certain circumstances.
  • Cashback becomes "confirmed" after the retailer's return period has elapsed, typically 30 to 90 days after purchase.
  • Returns, cancellations, and chargebacks will result in the reversal of associated cashback.
  • We reserve the right to adjust cashback rates at any time. Changes will not affect pending or confirmed cashback.
  • Minimum payout threshold is $10.00. Cashback below this threshold will be carried forward.
  • Inactive accounts (no login for 12 months) may forfeit unredeemed cashback after written notice.

5. Sweepstakes

Sweepstakes are governed by their own Official Rules, which are incorporated into these Terms by reference. In the event of a conflict between these Terms and the Official Rules for a specific sweepstakes, the Official Rules shall prevail. Key provisions include:

  • No purchase is necessary to enter any sweepstakes.
  • Entry through purchases is one method; alternative free entry methods are always available.
  • Maximum entries per user per sweepstakes: 5,000.
  • Sweepstakes are void where prohibited by law.

6. Affiliate Relationships

Epic Outdoor participates in affiliate programs with various outdoor retailers. When you click on a retailer link and make a purchase, we may earn a commission from the retailer. This commission is what funds our cashback rewards program. You will never pay more than the retailer's standard price when shopping through our links.

We are not responsible for the products, services, pricing, shipping, returns, or customer service of our retail partners. All purchases are subject to the respective retailer's terms and conditions.

7. User Conduct

You agree not to:

  • Use the Service for any fraudulent or unlawful purpose
  • Manipulate or attempt to manipulate cashback or sweepstakes entries through artificial means
  • Create multiple accounts to circumvent entry limits or other restrictions
  • Use automated tools, bots, or scripts to interact with the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service

Violation of these provisions may result in immediate termination of your account and forfeiture of any unredeemed rewards.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Epic Outdoor LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Content and Accuracy

We strive to provide accurate and up-to-date information about our retail partners, including commission rates, product descriptions, and pricing. However, we do not guarantee the accuracy, completeness, or timeliness of any information on the Service. Cashback rates and retailer availability are subject to change without notice.

Our blog content, including gear reviews and buying guides, represents our editorial opinions and should not be considered professional advice. Always conduct your own research before making purchasing decisions.

10. Limitation of Liability

In no event shall Epic Outdoor LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount of cashback rewards credited to your account in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Epic Outdoor LLC and its licensees, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Any confirmed and unredeemed cashback above the minimum payout threshold will be disbursed within 30 days of termination.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Vermont, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Chittenden County, Vermont.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
